1. The promoter
The promoter of the website giveaway (the “promotion”) is:
Resultstars
Christoph Sacher
Carrer l’Esperança, 32
07590 Cala Agulla, Illes Balears, España
Email: info@resultstars.com
Full provider details are in the legal notice. By submitting the application form you accept these terms and conditions.
2. No connection to Meta, Facebook or Instagram
This promotion has no connection to Meta Platforms, Facebook or Instagram. It is not sponsored, endorsed, administered by or associated in any way with those companies. It is run solely by the promoter named above.
All entrant details and data are submitted to the promoter, not to Meta. Please direct any questions, claims or complaints about the promotion to the promoter and not to Meta.
The same applies to every other platform on which this promotion is advertised, such as Google, YouTube, LinkedIn or TikTok.
3. Who can take part
Entry is open only to businesses, sole traders and freelancers that are actually trading at the time of application. Private individuals, associations without a commercial operation, businesses that have not yet been founded and projects with no recognisable offering are not eligible.
Further conditions:
- The person applying is at least 18 years old and authorised to act for the business.
- The business is based in Germany, Austria or Switzerland.
- The details given in the form are true, complete and current.
Employees of the promoter, anyone involved in running the promotion and their immediate relatives are excluded. Immediate relatives means spouses and partners, parents, children and siblings.
Businesses whose offering is unlawful or contrary to public decency are also excluded. The promoter reserves the right to decline applications from sectors it does not wish to build a website for — for example adult content, gambling, weapons or dubious financial products.
4. Entry period and timeline
The promotion runs in monthly rounds. Each round consists of:
- The 14th of the month, 23:59: first deadline. Applications received by then are in the current round.
- The 29th of the month, 23:59: final deadline (Central European Time, Europe/Berlin). The round closes after this.
- The 30th of the month: the promoter selects the winner from all valid applications in that round, notifies them and announces the decision.
What decides which round an application belongs to is the time it reaches the promoter. In months with fewer than 30 days — that is, February — the selection and the announcement move to the last day of the month and the first day of the following month respectively.
Both deadlines belong to the same round and lead to one winner. When an application arrives within the round has no bearing on the selection: an application sent on the 2nd is treated no better than one sent on the 28th. Anyone who misses a deadline applies in the next round.
An application that arrives after a round has closed takes part in the next round. Applications are not carried forward automatically: anyone who was not selected in one round is welcome to apply again in a later one.
5. How to enter
The only way to enter is through the application form on the giveaway page. There you describe your business, your current website situation and your reason for applying, and you leave your contact details.
Entry is free. There is no obligation to purchase: you do not have to book any service from the promoter or request a quote in order to enter or to win. No costs arise beyond the usual charges for your own internet connection.
One application per business per round is permitted. Multiple applications from the same business — including through different email addresses, people or trading names — do not improve the chances and may lead to exclusion from the round. Where a business submits several applications, the first one received applies.
6. The prize
The prize is a new, professionally designed website for the winner’s business, built by the promoter. The stated value of the prize is €2,500.
What is included
- Bespoke professional website with up to 5 pages
- Mobile and tablet optimisation
- Contact or enquiry form
- Basic SEO setup
- Existing content carried over where it makes sense
- One round of revisions
- Launch and setup
What is not included
- Domain
- Hosting
- Paid plugins and licences
- Ongoing support, maintenance and updates after launch
- Copywriting
The winner can take care of these items themselves or commission the promoter to do so — there is expressly no obligation to do either, and the prize does not depend on it.
Scope, cash alternative and transfer
The scope of the website is limited to the items listed above. Anything beyond that — additional pages, shop functionality, booking systems, multiple languages, integrations or further rounds of revisions — is not part of the prize and can be commissioned separately if wanted.
There is no cash alternative, no exchange and no offsetting of the prize against other services. The prize is not transferable to third parties and is tied to the business that applied. Any taxes or duties that fall due for the winner in connection with the prize are the winner’s responsibility.
Work begins once the details have been agreed with the winner. The promoter runs only a few projects at a time and therefore does not commit to a fixed completion date. The schedule is agreed jointly and depends on how quickly the winner supplies content and feedback.
7. The referral rule
After you apply you receive a personal referral link with a code of your own (for example: resultstars.com/w/K7QF3M). You can pass that link on to other businesses.
The rule: if a business applies through your personal referral link and that business is selected as the winner of the round, you also receive a website, with the same scope as described in section 6.
The following applies:
- At most one such bonus prize is awarded per round. Even if you have referred several businesses, you receive a maximum of one additional website per round.
- A referral only counts if the referred application actually came in through your individual referral link. Applications without that link cannot be attributed.
- An application that has already been received cannot be attributed to a referrer afterwards — not by phone, not by email, and not even if both sides ask for it.
- Self-referrals do not count. Applying again through your own link, or registering another business of your own through your own link, creates no entitlement.
- Multiple or duplicate applications from the same business do not count as a referral.
- The referrer and the referred business must have applied in the same round.
- The referrer must have submitted a valid application themselves and must be eligible under section 3.
The same rules apply to the bonus prize as to the main prize: no cash alternative, no transfer to third parties, the same scope of work and the same obligations to contribute.
8. How the winner is chosen
This promotion is not a draw and not a lottery. The winner is chosen by the promoter — it is a reasoned selection decision made against the following criteria:
- Fit of the project: can the work realistically be done within the scope described?
- Expected benefit: how much difference does a new website actually make for this business?
- Willingness to take part in the process: is the business prepared to be involved as the site is built, and to let the result be published as a reference (see section 9)?
We will say this plainly: the decision is subjective. It is made by a person, not drawn at random, and the promoter has an interest of its own in choosing a project it can show off well. Anyone who applies should know that — a neutral body, a panel of independent judges and a random mechanism are expressly not part of this process.
Incoming applications are pre-sorted automatically, for example according to whether an existing website was given or how detailed the description is. That pre-sorting serves only to keep an overview. The winner is in every case selected personally by the promoter; no decision is made on an automated basis alone.
There is no entitlement to a prize. There is likewise no entitlement to an explanation of the selection decision.
9. What the winner contributes
The winner is notified using the email address given in the form, and where appropriate by phone as well. The winner is responsible for making sure messages can be delivered; please check your spam folder too.
Deadline to respond: if the winner does not come back to us within 7 days of the notification, the claim to the prize lapses. The promoter may then award the prize to another business from the same round or close the round without a winner.
For the website to come about, the winner contributes to the work. In practice that means:
- Supplying the content needed — text, images, logo, service details — in a usable form and with the necessary rights of use.
- Feedback and approvals within a reasonable period, usually within 7 days.
- Naming one contact person who is able to make decisions.
The winner confirms that they hold the necessary rights to all content they supply and that using it does not infringe the rights of third parties. If content or feedback fails to arrive for more than 8 weeks, the promoter may close the project in the state it has reached.
Publication as a reference
The promoter makes this promotion visible. The winner agrees that the result may be published as a reference — company name, screenshots of the website before and after, a short description of the project — on the promoter’s website, on social networks and in advertising.
You can decline this. Publication is not a condition of the prize: anyone who does not want to be published says so before the project starts and still receives the website in full. In that case the promoter does not name the business and does not use screenshots that would make it identifiable. Consent once given can be withdrawn at any time with future effect; ads or posts already running are then removed, or not distributed further, within a reasonable period.
Willingness to be published is, however, one of the selection criteria under section 8. Anyone who rules publication out from the start therefore has a lower chance of being selected — we would rather say that in advance too.
10. Data protection
The controller for the processing of personal data in this promotion is the promoter named in section 1. Our privacy policy applies in addition to this section.
What we collect
- Business details: a description of what you do, your existing website, your reason for applying.
- Contact details: the name of the contact person, email address, WhatsApp number.
- Entry data: your referral code, any referral code you arrived through, the round and the time of your application, and your consent choices.
- Technical data: IP address, browser identifier and the source of the visit (campaign parameters). If you have consented to marketing cookies, also the Meta pixel identifiers, so that we can measure whether our ads work.
Why, and on what legal basis
- Running the promotion — reviewing applications, selecting and notifying the winner, attributing referrals, delivering the prize. Legal basis: Art. 6(1)(b) GDPR (pre-contractual steps and the performance of the entry relationship).
- Contacting you about your website, including if you do not win — legal basis: Art. 6(1)(f) GDPR, our legitimate interest in approaching businesses that have actively shown an interest in a new website. If you have additionally consented to receive advertising, we rely on Art. 6(1)(a) GDPR.
- Reach measurement and advertising — only on the basis of your consent, Art. 6(1)(a) GDPR in conjunction with § 25(1) TDDDG. Without consent, no marketing services are loaded.
- Preventing abuse — detecting duplicate and false applications. Legal basis: Art. 6(1)(f) GDPR.
What we are actually going to do
So that nothing takes you by surprise: we will write to you. Even if you do not win, we will get in touch — by email and where appropriate by phone — and talk to you about your existing website and what we would change about it. That is precisely our interest in running this promotion, and we would rather say it here than let you find it out later.
You can object at any time. An informal email to info@resultstars.com is enough — no reasons needed, and with no disadvantage to your current application. We then stop contacting you. Consent you have given can be withdrawn the same way, with future effect.
Recipients, retention and your rights
Your data is passed to service providers who support us in running the promotion — hosting and database operation, email delivery, and a messenger service for internal notifications. Those providers are contractually bound to process data on our instructions only. Your data is not sold to third parties.
We disclose no personal data to other entrants. Anyone who uses your referral link sees nothing at all about you: not your name, not your email address, not your WhatsApp number. The link attributes the referral internally and nowhere else.
We keep application data for the duration of the round and then for 12 months, so that we can deal with follow-up questions, referrals and subsequent contact. After that it is deleted, unless statutory retention obligations apply or a business relationship has come about. If you object to being contacted, we delete or block your data without delay, to the extent that it is no longer needed to run the promotion.
You have the rights of access, rectification, erasure, restriction of processing, data portability and objection, as well as the right to lodge a complaint with a supervisory authority. Details are in the privacy policy.
11. Checks, exclusion and changes
Before awarding the prize, the promoter may verify that the entry conditions are met and may request suitable evidence of the identity of the contact person and of the business activity — for example a trade licence, a register extract or a VAT identification number. If such evidence is not provided within 7 days without a comprehensible reason, the prize may be awarded to another business.
An entrant may be excluded from the promotion if they
- give false, incomplete or misleading information,
- submit several applications for the same business,
- manipulate the referral rule, for example through sham applications, automated entries or invented businesses,
- use technical means to gain an advantage, or
- breach these terms and conditions.
In those cases a prize already awarded can be withdrawn after the fact.
The promoter reserves the right to cancel, postpone or change the promotion in whole or in part for good cause — for example in the event of technical faults, attempted manipulation, legal obstacles or other circumstances that make proper running of the promotion impossible or considerably more difficult. Entrants will be informed at the email address they gave. No claims arise from this for entrants, unless the promoter acted intentionally or with gross negligence.
These terms and conditions may be adjusted for future rounds. For a round already under way, the version published on this page at the time of your application applies.
12. Legal recourse and final provisions
Legal recourse is excluded. There is no entitlement to take part or to receive a prize.
The promoter is liable without limitation for intent and gross negligence, and for injury to life, body or health. Otherwise it is liable only for breach of material contractual obligations, and then limited in amount to the foreseeable damage typical for this type of contract. No liability is accepted for faults in data transmission, for applications that are lost or delivered late, or for the failure of third-party networks or services.
Should any provision of these terms and conditions be or become wholly or partly invalid, the validity of the remaining provisions is unaffected. The statutory rules take the place of the invalid provision.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the state in which an entrant is habitually resident remain unaffected. The promotion is aimed at businesses; it is not a consumer promotion.
Questions about these terms and conditions go to info@resultstars.com.
13. A note about this document
These terms and conditions have not been reviewed by a lawyer. They are a carefully drafted document, but they are no substitute for legal advice. Before the campaign starts they should be checked by a lawyer specialising in competition and data protection law against the legal position in Germany, Austria and Switzerland — in particular the points on promotion law and the prohibition on tying, the referral rule, the legal basis for follow-up contact under Art. 6(1)(f) GDPR, and the choice-of-law and liability clauses. This English version has also not been checked against UK or Irish promotion rules — including the CAP and BCAP Codes, the ASA’s requirements for prize promotions and UK and Irish data protection law. If the campaign is ever run in the UK or Ireland, it needs a separate review there first.
